 Nepal suffered through a decade-long armed conflict 1996-2006. The then Communist Party of Nepal (Maoists) launched “people’s war” during this period. Several successive governments followed the policy to control the conflict by means of using force during this period and as a result the government deployed security forces to counter the insurgency which committed the gross human rights violations. These efforts were instrumental in resolving the armed conflict. Among several human rights violation by the state, extra judicial execution of Ms. Maina Sunar by the then Royal Nepal Army (RNA) was one of the crimes against humanity. The issue became a matter of hot debate and condemnation at both national and international levels. Similarly, the rebel group also committed numerous human rights abuses during this period.
Impunity is widespread. The perpetrators who committed inhuman acts and violated people’s human rights have not brought before the law and the conflict survivors and their families have not got justice yet. It was important to continue raising this issue by different walks of lives. As a result, Cine Makers, a prominent company in film media, took initiative in filming this real story and bring into the notice and campaign to the people and authorities.
Nepali Army personnel arrested Ms. Maina Sunar, 14 year school girl, from her home at Kharelthok VDC-6, Kavrepalanchowk district in …put date.. She was arrested on the charge of being Maoist cadre and taken into the nearby army barrack and given severe torture to a death. The army personnel kept threatening other villagers and Maina’s parent when they approached to find her whereabouts. In the mean time, the media picked up the story of Maina’s disappearances. The media and human rights defenders visited Main’s village and investigated the case. It revealed that she was arrested by the Army personnel and taken to the barrack. Initially, Army denied her arrest. This matter became a national issue at media, human rights defenders which created tremendous pressure to the political actors and government, including the Army to disclose whereabouts of Maina. Army commissioned an inquiry committee which confirmed that Maina’s death was occurred in Army custody.
Finally, Army accepted the fact that she was died in the barrack. However, Army claimed that Maina attempted to run away from the barrack despite warning and finally killed. Later, the human rights organization’s conducted an investigation and excavated the graveyard in the Army barrack. Finally, it was proven that she was killed by the Army with wrong intention. A write petition was filed in the Supreme Court to take action against the perpetrator and give justice to the Maina’s family.
There is a unique documentation of misbehaviors over the ordinary citizen by the security forces. It is also State of account of extra judicial killing, disappearances, torture and trauma committed by the security force during the counter insurgency period. The film gives message that the excessive use of powers is against the humanitarian law and human rights standards. It also advocates for giving justice to the victims and appeal to end situation of gross human rights violation and culture of impunity.
